These terms and conditions of use (hereinafter the "Terms") apply between PEETCHR, a simplified joint-stock company, registered with the Paris Trade and Companies Register under No. 980 220 164, with its registered office at 38 rue des Mathurins, 75008 Paris (hereinafter "PEETCHR") and any user (hereinafter the "User(s)") of the job application response service offered by PEETCHR (hereinafter the "Service").
DEFINITIONS
Usage Data: refers to information automatically collected from the Platform (or third-party services employed by the Platform), which may include: IP addresses or domain names of computers used by Users who use the Platform, URI addresses (Uniform Resource Identifier), the time of the request, the method used to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server's response (successful result, error, etc.), the country of origin, browser and operating system characteristics used by the User, various details related to time per visit (e.g., time spent on each page on the Platform) and details related to the path followed on the Platform with special reference to the sequence of pages visited, and other parameters concerning the User's operating system and/or computer environment.
Personal Data (or Data): refers to any information concerning a natural or legal person, an institution or an association that is, or can be identified, even indirectly, by reference to any other information, including a personal identification number.
Data Subject: refers to the natural or legal person to whom the Personal Data refers.
Data Controller (or Owner): refers to the natural or legal person, public administration or any other entity, association or organization that is authorized, even jointly with the Data Controller, to make decisions regarding the purposes and methods of processing Personal Data and the means used, including security measures concerning the operation and use of the Platform. Unless otherwise specified, the Data Controller is the owner and operator of the Platform. In this case, the Data Controller (or Owner) refers to PEETCHR.
Processing (or Process): refers to any operation or set of operations performed with or without the help of automated processes and applied to personal data or sets of Personal Data, such as collection, recording, organization, structuring, storage, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of making available, alignment or interconnection, limitation, erasure or destruction.
Third-Party Services: refers to third-party messaging services through which Users can access the Service, namely, without this list being exhaustive, WhatsApp, Messenger, Telegram, Instagram, TikTok or WeChat.
Website: refers to the website through which the Service is offered.
ACCEPTANCE OF THE TERMS AND CONDITIONS OF USE
The use of PEETCHR's job offer response Service implies full and complete acceptance of these Terms by Users. Consequently, by simply using the Service, the User is deemed to have accepted these Terms.These Terms may be modified or supplemented at any time by PEETCHR.
Users of the Service are therefore invited to consult them regularly.
DELETION OF USER ACCOUNT

INTELLECTUAL PROPERTY
All elements (i) present on the Website, including any text, photograph, image, sound, graphic element, etc., (ii) comprising the Website, including its graphic charter, structure, navigation interfaces, databases, etc., of whatever nature and in whatever form, and (iii) any software used on the Website (hereinafter the "Properties") may be protected by intellectual property rights and belong to PEETCHR and/or third parties.
The User is therefore prohibited from copying, modifying, integrating the Properties on any medium whatsoever, performing reverse engineering or using any other method to attempt to access the source codes and/or protocols of the Properties. The User is also prohibited from selling, assigning, licensing, sub-licensing, transferring, giving as security, transmitting in any way whatsoever the Properties.It is reminded that all distinctive signs, particularly trademarks and logos, are and remain the property of PEETCHR or that of the owners of the intellectual property rights concerned.
Recognizing these exclusive rights to these signs, the User agrees not to use them other than in connection with consulting the Website and not to infringe the intellectual property rights of PEETCHR or those of the owners of the rights concerned.
Any use of the Properties other than that related to consulting the Website is prohibited without the express, written and prior agreement of the owners of the rights concerned.
ACCESS AND USE OF THE SERVICE AND WEBSITE
The User agrees to access the Service and the Website using recent equipment, free from viruses, and with an up-to-date latest generation browser.The User confirms possessing the technical knowledge necessary to ensure correct use of the Service, particularly with regard to handling their data.
The User agrees to use the Service in good faith.The User is entirely responsible for the use of the Service.
PEETCHR cannot be held liable for any malfunction of the Service resulting in particular from (i) a failure of the internet network and/or (ii) misuse of the Website by the User.
MAINTENANCE OF THE SERVICE AND WEBSITE
At any time, the operation of the Service and the Website may be temporarily interrupted to carry out maintenance or update operations.
ADVERTISING ON THE WEBSITE
PEETCHR may decide at any time to place advertising spaces on the Website and enjoys complete freedom when it comes to choosing its advertisers, types of advertisement display as well as their position on the Website.
LIMITATION OF PEETCHR'S LIABILITY
PEETCHR cannot be held liable for direct and indirect damage caused to the User's equipment when accessing the Website and resulting either from the use of equipment meeting the specifications indicated in Article 6 of the Terms or from the appearance of a bug or incompatibility.In general, given the technical IT and telecommunications constraints of using the Website, PEETCHR cannot be held liable in the event of direct and/or indirect damage caused by a malfunction, which would not be attributable to PEETCHR and/or difficulty in accessing one or more stages of the Website, due in particular to the inconveniences inherent in the use of the internet network, such as a service interruption or the presence of computer viruses.

Retention period of personal data

More specifically, the Data is kept for the following periods: xx years after the collection of Personal Data.In order to resolve conflicts, prevent fraud, abuse, enforce any contracts concluded and/or comply with legal obligations, PEETCHR reserves the right, in compliance with legal and regulatory requirements, to retain certain Processed Data for a limited period, even if they are no longer necessary for the management of the contractual relationship between the User and PEETCHR.
Location of personal data processing
The Data is processed in France, on the premises of PEETCHR's subcontractor in charge of data hosting.

Transmission of personal data to third parties
The Data may be transmitted:to PEETCHR's clients, who originated the recruitment request and/or are looking for talent and wish to obtain candidate contacts;
to PEETCHR's external service providers, who Process this Data either (i) as Data Controller or (ii) as data processors (particularly hosting providers).The Data may be transferred and Processed outside the European Union, particularly to ensure Data hosting.
In this case, and prior to any transfer, PEETCHR ensures the security of the transfer of this Data. In the event that the legislation of the country concerned by the Data transfer has not been recognized as providing an adequate level of Data protection, PEETCHR will ensure that necessary measures are put in place in accordance with the GDPR (binding corporate rules (BCR), cross-border flow agreements complying with the standard contractual clauses issued by the European Commission).
Method and security of personal data processing
The Data Controller processes User Data appropriately and takes all necessary security measures to prevent unauthorized access, disclosure, unauthorized modification or destruction of the Data.The Processing of Data is carried out using computers or IT tools and following procedures and organizational methods closely linked to the purposes indicated. Access to the Data, besides that reserved for the Data Controller, may in some cases be granted to certain categories of persons in charge of the site's operations (administration, sales, marketing, legal department, system administration) or to external parties (such as third-party technical service providers, messaging services, hosting providers, IT companies, research institutes for survey purposes, payment providers...) designated, where applicable, as Data processors by the Owner. The updated list of these parties can be requested at any time from the Data Controller.
Rights of Data Subjects
In accordance with the regulations in force, Law No. 78-17 of January 6, 1978, as amended, relating to data processing, files and freedoms and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, the Data Subject has, at any time:the right to access, rectify and/or delete Data Processed by PEETCHR ; the right to object to the Processing of Data, to request PEETCHR to limit the Processing of Data and/or the portability of Data;
the right to withdraw or modify their consent to the collection and Processing of Data.

Legal action:
The Personal Data of the Data Subject may be used for legal purposes by the Data Controller, before the Courts or at any stage leading to possible legal action resulting from inappropriate use of the Service or the Website or related services.The Data Subject is aware that public authorities may require the Data Controller to disclose Personal Data.
System log and maintenance:
For operation and maintenance purposes, the Website and any other third-party service may collect files that record interactions with the Platform (System Log) or use any Personal Data (such as the IP address) for this purpose.

Modification of the privacy policy:
The Data Controller reserves the right to modify this privacy policy at any time by giving notice to Users of the Service.If a User objects to any modification made to this privacy policy, the User must cease using the Service and may request the Data Controller to delete the Personal Data. Unless otherwise specified, the privacy policy in effect at that time applies to all Personal Data that the Data Controller holds about Users of the Service.
Cookies
The User is informed that the Cookies used by PEETCHR only record information relating to navigation on the Platform (pages consulted, date and time of consultation, etc.), which the User will be able to read during subsequent visits and/or connections to the Platform. These Cookies are used to facilitate the use of the Platform in that they allow displaying information entered as part of using the Platform, conducting statistical studies regarding the use of the Platform (number of sessions, connection duration...) as well as measuring its audience.
USE OF THIRD-PARTY SERVICES
As part of using the Service, the User is offered the possibility to communicate with recruiters via different Third-Party Services.The User is informed that any use of Third-Party Services entails full and complete acceptance of the terms and conditions of use and the privacy policy of said Third-Party Services.In addition, when creating their user account through the login button, the User may authorize the Data Controller to collect their name, first name, profile picture and email address. As a data processor, the Data Controller undertakes to present sufficient guarantees regarding the implementation of appropriate technical and organizational measures and in particular to respect the privacy policy of third-party connection services.
APPLICABLE LAW AND JURISDICTION
Any dispute related to all or part of the provisions set out in these Terms is subject to French law.Except in cases where the Law does not permit it, exclusive jurisdiction is attributed to the competent courts of Paris.
